that's what I meant. they can press the charge, but it's incredibly hard to get an actual conviction, so most prosecutors in a case like this wouldn't bother with it, and instead stick to the much more provable drug case.

the fact that drugs were heavily involved makes it just a murky-water mess, but the same logic applies in that she lied about her age, had id backing that up, and was consenting to sex with him. his fault lay in being addicted to drugs, not in fucking a minor since he was under the impression she was not.
