You're all idiots except for me

Rundown: [community profile] rpanons is an anonymous community for role-play related topics. This place serves as a forum for game discussions, canon discussions, RP solicitations (ATP, game ads, open memes), and advice. The occasional off topic comment is inevitable, but please keep heated social and political topics to their respective communities. Posting them here will only get them frozen. Subsequent threads made to bypass a freeze will then be deleted.

Rules:

Do not post pornographic or shocking images.
Do not share private entries, plurks, chat logs, etc.
Do not use this community as your social/political/hatespeech soapbox.
Do not be redundant. One page does not need three or more threads on one topic/theme.
Do not treat this comm like your personal Plurk or Twitter. Off-topic happens, but it should be open for discussion and not just a play-by-play of your life. No one cares.

Does pepper spray cause temporary blindness? Pepper spray has a blinding effect so make sure a victim does not accidentally fall down stairs, walk into the street or operate a motor vehicle.

yes, be sure your attempted rapist doesn't fall down the stairs, that would be a problem

Honestly, that's a smart idea because the person who was nearly a victim of rape could end up doing time if the would be rapist dies. With how often the victim is dragged through the mud and made out to have been leading the rapist on, etc. it wouldn't be a surprise to see the courts paint the victim as a murderer.

... anon

even without all the baggage around rape, murder in self-defense is still murder.

Not in stand your ground states.

(Anonymous) 2015-05-22 03:30 pm (UTC)(link)
in stand your ground states you're getting hanged for the crime of having a functioning vagina anyway, so it doesn't really matter

(Anonymous) 2015-05-22 04:03 pm (UTC)(link)
uh, look up any legal definition of murder ever. that's not murder.

(Anonymous) 2015-05-22 04:06 pm (UTC)(link)
Not it's not. If you mace someone who's attacking you and they then fall down the stairs it can be ruled as an accidental death/killing, since killing in self defense is the single most common reason for that verdict to be granted. Though like many things this depends hugely on the state, jurisdiction, and what mood the prosecutor happens to be in at the time.

And unless you live in an extremely regressive area, that wouldn't qualify as murder, because murder requires intent. The intent behind pepperspray is very specifically non-lethal; if someone happens to wander into traffic or something, the person who sprayed them might be on the hook for manslaughter, but most places wouldn't even charge that.

lawyernon

self-defense is a defense that may be asserted to a charge of murder. it is a valid reason for a not guilty verdict.

and before anyone says anything, it's also a defense to assault/battery/etc. and defending yourself from a rape is universally recognized at common law as a defense to murder. there is no state in which that isn't a thing.

(Anonymous) 2015-05-22 08:34 pm (UTC)(link)
You're assuming self-defense can be proven. Rape commonly is a crime that has zero witnesses and a lack of evidence and what little evidence there is can easily be spun by a good prosecutor to look like murder and not self-defense. That's a big issue with the courts in at least the US. At minimum the victim of attempted rape is going to be spending a lot on a good lawyer.

defending yourself from a rape with reasonable force is a thing.

any prosecutor worth their salt would milk those last three words for all they're worth. it'd be a douchey thing to do but it's a douchey profession.

+1

although if they die, you're probably in the clear. self defense injury is what you need to watch out for. a dude broke into someone's house and successfully sued them for his injuries.

(Anonymous) 2015-05-22 03:08 pm (UTC)(link)
you do realize pepper spray is used for stuff besides rapists, right?

(Anonymous) 2015-05-22 07:51 pm (UTC)(link)
expecting people to stick around to make sure their attempted mugger/carjacker/other assailant doesn't fall down the stairs is stupid, too.

Or, you know, black kids being targeted by racist coppers.
