there is merit in the case, based on the fact that he was essentially unable to do anything for about seven months, since they could have called him back at any time. take that time to travel? but what if you're called in tomorrow? take another job to pass the time? oops, you don't know your availability. etc etc, it's still first world as fuq, but there's legitimate "distress" there, aka basically being held hostage by your job because you have no idea if/when they'll want you back.

the whole "bore-out" thing is bullshit tho and they should have left it out of the case.
